Heroic Money-Back Guarantee — Terms & Conditions
Why I offer this
Commissioning custom art can feel risky. I offer this guarantee so you can jump in without fear. If I truly miss the mark based on the information you gave me, I will make it right. What this is not is a free preview program. I am one artist putting in real time; I expect the same good faith from you.
1 | Scope and key definitions
1.1 Where this applies. These terms apply to all commission listings purchased on FramedFantasy.com.
1.2 Initial Concept / Polished Concept. A reduced-resolution preview of your portrait delivered for evaluation. It is not final art and not licensed for any use.
1.3 Brief Materials. Whatever you gave me before I created the Initial Concept: your written description, references, and/or my optional Blueprint form. You do not have to use the Blueprint, but your guarantee is judged only against what you actually provided.
1.4 Base Commission Value. The listed price for the core commissioned artwork, excluding add-ons, upgrades, rush, printing, framing, or shipping.
2 | Refund eligibility window
2.1 I will refund 100% of the Base Commission Value (and any unused shipping fees) only if:
a) you email me before any revisions begin; and
b) your email is received within 72 hours of the Initial Concept delivery; and
c) in your good-faith judgment the Initial Concept misses the mark relative to your Brief Materials.
2.2 If you ask for any revision, or the 72-hour window passes, the guarantee expires and the commission becomes non-refundable.
2.3 Acceptance by inaction. No reply within 72 hours counts as acceptance of the Initial Concept.
2.4 Delivery timestamp. The 72-hour window begins at the time the Initial Concept is sent to you via email, text, or any other agreed communication channel, regardless of when you open, view, or acknowledge the message. Delivery is measured by our sending records, not by your receipt or viewing of the message.
3 | What "misses the mark" means (and what it doesn't)
3.1 The guarantee covers situations where, in good faith, the Initial Concept does not reasonably reflect the core content of the Brief Materials you supplied (for example, the wrong race/species, the wrong signature weapon, or the omission of a clearly specified defining feature).
3.2 The guarantee does not cover:
a) Omissions or vagueness in your brief (including "forgot to mention" details, unclear references, or critical info added after I deliver the Initial Concept);
b) Buyer's remorse, financial stress, schedule changes, or "I changed my mind";
c) Requests for a new art direction or style that wasn't in your Brief Materials or is outside my house style;
d) Printing, rush, add-ons, or other upgrades (see §5);
e) Any public sharing, distribution, or use of the Initial Concept (see §4);
f) Changes or additions that fall under Section 4.5 (major revisions requiring additional payment), including pose redos, significant outfit changes, or major forgotten details.
4 | Intellectual property and usage
4.1 Until you accept the artwork, the Initial Concept is for private evaluation only. Do not post, reproduce, use, or distribute it.
4.2 If a refund is granted, all rights remain with me. You must delete any files I sent and keep nothing beyond private, non-public reference.
5 | Limitations and exclusions
5.1 One refund per 12 months per person, household, and payment instrument (whichever is broader).
5.2 The guarantee applies only to the Base Commission Value. It does not refund add-ons or upgrades (examples: Dual Vision Upgrade, Pet Add-On, Custom Background Upgrade, rush, printing, framing).
5.3 Printing, framing, and shipping already produced or shipped are not refundable. Unused shipping tied to a refunded base may be returned.
5.4 Bad-faith or abuse. I may decline the guarantee if you:
a) refuse to email me within the 72-hour window;
b) begin or request revisions and then seek a refund;
c) share or use the Initial Concept publicly or commercially;
d) file a chargeback or payment dispute before completing the refund process in §6;
e) show a repeat pattern of refunds across linked identities, addresses, devices, or payment methods;
f) provide intentionally incomplete or misleading Brief Materials in an attempt to manufacture a guarantee claim;
g) attempt to obtain both a refund and a chargeback for the same transaction.
6 | How to request a refund
6.1 Email Jan@FondlyFramed.com with subject line "Refund – [Order #]" within 72 hours of delivery of the Initial Concept.
6.2 In the email, include your order number and a short explanation of how the Initial Concept misses the mark relative to your Brief Materials. If I ask clarifying questions to understand the mismatch, please reply so I can verify eligibility.
6.3 Refunds are processed to the original payment method within 5 business days of confirmation. If a refund is granted, you agree to delete all files and not use the work.
6.4 Exclusive remedy. The refund process described in this Section 6 is the sole and exclusive remedy available to you for any dissatisfaction with the Initial Concept. You agree to exhaust this process before pursuing any other remedy, including but not limited to chargebacks, payment disputes, or claims through third-party platforms.
7 | Disputes, chargebacks, and payment disputes
7.1 Mandatory pre-dispute resolution. By placing an order, you agree that you will contact us directly at Jan@FondlyFramed.com and allow a minimum of 10 business days for resolution before filing any chargeback, payment dispute, or claim with your bank, credit card company, PayPal, or any other payment provider or third-party platform. The refund process in Section 6 is designed to resolve all legitimate concerns, and we commit to responding to every refund request within that window.
7.2 Chargebacks filed without following Section 6 constitute a breach of these Terms. If you file a chargeback or payment dispute without first completing the refund process described above, you acknowledge and agree to all of the following:
a) The chargeback constitutes a material breach of this agreement.
b) You will be responsible for all costs we incur as a result, including but not limited to: chargeback fees imposed by our payment processor, administrative costs of responding to the dispute, and any collection costs.
c) We reserve the right to recover the full transaction amount plus all associated fees and costs through any lawful means, including but not limited to collections, small claims court, or any other available legal remedy.
d) We may submit all documentation related to your order (including your Brief Materials, our communications, delivery records, and these Terms) to your payment provider in response to the dispute.
e) You will be permanently barred from future purchases and services with FramedFantasy.
7.3 Dual recovery prohibition. If you receive a refund under Section 6 and subsequently file a chargeback for the same transaction, or if you file a chargeback while a refund request is pending, you agree that the full amount of the refund plus all chargeback fees and costs are immediately owed to us as a debt, and we may pursue collection through any lawful means.
7.4 Good-faith commitment. We genuinely want every customer to be happy. If you feel your concern was not adequately addressed through the refund process, please email us again and let us know. We will do our best to resolve the issue. Chargebacks harm small businesses significantly. We ask that you give us the opportunity to make things right before involving your bank.
7.5 Any dispute not resolved through the process described above will be handled under the governing law of our principal place of business.
7.6 Acknowledgment. By completing a purchase on FramedFantasy.com, you confirm that you have read, understand, and agree to the chargeback and dispute resolution terms in this Section 7. This acknowledgment is a material part of the agreement between you and FramedFantasy.
By commissioning with me on FramedFantasy.com, you acknowledge and agree to these Heroic Money-Back Guarantee terms.
Hall of Heroes Giveaway — Official Rules
1 | Overview
FramedFantasy operates the Hall of Heroes, a community gallery where players and creators can showcase their characters. From time to time, we run giveaways through the Hall of Heroes (each a "Giveaway") offering free character portrait commissions or other prizes.
2 | No purchase necessary
No purchase is necessary to enter or win any Giveaway. A purchase will not increase your chances of winning. Giveaways are void where prohibited by law.
3 | Eligibility
3.1 Giveaways are open to legal residents of jurisdictions where such giveaways are permitted, who are 18 years of age or older at the time of entry (or the age of majority in their jurisdiction, whichever is greater).
3.2 Employees, contractors, and immediate family members of FramedFantasy are not eligible.
4 | How to enter
4.1 Entry methods will be described on the Hall of Heroes page or other designated entry page at the time of each Giveaway. Entry methods may include, but are not limited to, submitting a character to the Hall of Heroes, signing up for our email list, or other actions specified at the time.
4.2 You may submit multiple characters to the Hall of Heroes. Each valid character submission counts as a separate entry unless stated otherwise in the specific Giveaway rules.
4.3 Existing FramedFantasy portrait owners may receive bonus entries as described in the specific Giveaway rules. This does not conflict with the "no purchase necessary" requirement because free entry methods are always available.
5 | Winner selection and sole discretion
5.1 Winners are selected at the sole and absolute discretion of FramedFantasy. We are not required to use random selection, and we may consider any factors we choose when selecting a winner, including but not limited to: the quality, creativity, or completeness of a submission; the story or character concept shared; community engagement; or any other criteria we determine.
5.2 We are not required to disclose our selection criteria or explain why a particular entry was or was not selected.
5.3 Winner selection is final. No appeals, challenges, or complaints regarding winner selection will be considered.
5.4 We may select zero winners, one winner, or multiple winners for any Giveaway at our discretion.
6 | Disqualification and entry removal
6.1 We reserve the right to disqualify any entry and remove any submission from the Hall of Heroes at any time, for any reason, at our sole discretion, with or without notice.
6.2 Without limiting the above, we will disqualify and may remove entries that we believe, in our sole judgment, involve any of the following:
a) Fraudulent, deceptive, or misleading information;
b) Any attempt to manipulate, rig, or game the Giveaway or the Hall of Heroes, including but not limited to: automated submissions, coordinated voting schemes, bot activity, or any form of artificial engagement;
c) Content that is offensive, inappropriate, infringing on the intellectual property of others, or otherwise objectionable;
d) Entries that do not comply with the stated entry requirements;
e) Any conduct that we believe undermines the fairness, integrity, or intended spirit of the Giveaway or the Hall of Heroes community.
6.3 If we determine that a person has attempted to cheat, game, or manipulate any Giveaway, we may permanently ban that person from all future Giveaways and remove all of their submissions from the Hall of Heroes.
7 | Modification, suspension, and cancellation
7.1 We reserve the right to modify, suspend, or cancel any Giveaway at any time, for any reason, at our sole discretion, with or without notice. If a Giveaway is canceled, we are under no obligation to select a winner or award any prize.
7.2 We may change the rules, entry methods, prize details, duration, or any other aspect of a Giveaway at any time.
8 | Prizes
8.1 Prizes are non-transferable and cannot be exchanged for cash or substituted unless otherwise stated.
8.2 We reserve the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.
8.3 Winners are solely responsible for any taxes, fees, or other costs associated with accepting a prize.
9 | Content license
9.1 By submitting a character to the Hall of Heroes, you grant FramedFantasy a non-exclusive, royalty-free, worldwide, perpetual license to display, reproduce, and use your submission (including character name, backstory text, and any uploaded images) on the Hall of Heroes gallery, on our website, and in our marketing and social media channels.
9.2 You represent and warrant that you own or have the necessary rights to all content you submit, and that your submission does not infringe on the intellectual property or other rights of any third party.
9.3 If you submit an image of a character portrait that was created by another artist, you must have permission from that artist to share the image publicly. FramedFantasy is not responsible for verifying third-party rights and may remove any content upon receiving a valid complaint.
10 | Limitation of liability
10.1 FramedFantasy and its owners, employees, and agents are not responsible for any injury, loss, or damage of any kind resulting from participation in any Giveaway or the acceptance or use of any prize.
10.2 By entering, you release FramedFantasy from any and all claims, damages, and liabilities arising from or related to the Giveaway.
11 | Privacy
11.1 Information collected through the Hall of Heroes and Giveaway entries is governed by our Privacy Policy.
SECTION 1 - ONLINE STORE TERMS

You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.
SECTION 2 - GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 3 - ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information.
Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
SECTION 4 - INTELLECTUAL PROPERTY, USAGE, AND REVISIONS POLICY
4.1 Initial Concept Evaluation Until you accept the artwork, the Initial Concept is for private evaluation only. Do not post, reproduce, use, or distribute it.
4.2 Refund and Rights If a refund is granted, all rights remain with me. You must delete any files I sent and keep nothing beyond private, non-public reference.
4.3 Unlimited Refinement Revisions FramedFantasy offers unlimited refinement revisions to ensure your satisfaction with your commissioned artwork. This means we will work with you to perfect your piece through adjustments, tweaks, and refinements based on the original Brief Materials and concept you approved during the initial confirmation phase.
4.4 What Unlimited Revisions Include (No Additional Cost):
- Color corrections and adjustments (hair color, eye color, skin tone, clothing colors, etc.)
- Lighting, contrast, and saturation refinements
- Minor detail additions or modifications that were included in your original Brief Materials
- Expression fine-tuning within the approved pose
- Small accessory adjustments or refinements
- Background color or tone adjustments (for backgrounds included in your original order)
- Detail enhancement or clarification of existing elements
4.5 What Requires Additional Payment:
The following changes constitute new work beyond refinement and require additional payment as they involve substantial rework or creation of new content:
a) Pose Changes or Redos - Any request to change the character's pose, stance, or body position after the Initial Concept has been delivered.
b) Major Outfit or Wardrobe Changes - Significant redesigns of clothing, armor, or attire that differ substantially from what was described in your original Brief Materials.
c) Forgotten or Newly Added Major Elements - Large elements, features, or details that were not mentioned during the initial confirmation phase, including but not limited to:
- New weapons, shields, or major equipment
- Significant armor pieces or accessories
- Major props or items
- Substantial tattoos, scars, or markings
- Additional characters or creatures not originally specified
d) Concept Direction Changes - Requests to change the overall artistic direction, mood, setting, or style after you've approved the Initial Concept.
e) Background Upgrades - Adding or significantly changing a background that was not part of your original order.
4.6 Why This Policy Exists
Each commissioned piece represents significant artistic time and effort. The initial confirmation phase is designed to capture all essential details so that revisions focus on refinement rather than recreation. This policy ensures that you receive unlimited fine-tuning to perfect your artwork within the agreed scope, while major changes that require substantial rework are fairly compensated.
4.7 Additional Work Quotes
If you request changes that fall outside the scope of included revisions, we will provide you with a quote for the additional work before proceeding. You are under no obligation to accept the quote, and we will deliver your piece in its current state if you prefer.
4.8 Importance of Initial Brief
To minimize additional costs and ensure the best results, please provide comprehensive details during the initial confirmation phase, including:
- Complete character or subject description
- Outfit, armor, or clothing details
- Weapons, accessories, and equipment
- Pose preferences or restrictions
- Any critical "must-have" features or details
- Reference images (highly recommended)
The more detailed your initial brief, the fewer surprises and additional costs you'll encounter during the revision process.
SECTION 5 - PRODUCTS OR SERVICES
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Refund Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right to limit the sales of our products or services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer.
All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
Each of our custom artworks is meticulously hand-crafted by a dedicated artist who pours their skill into every detail of your character or subject. FramedFantasy employs a proprietary assisted artistic process utilizing stable diffusion technology as the foundational base for all commissioned artwork.
The base serves as the initial composition framework, which is refined, enhanced, and customized by a dedicated artist through our established artistic workflows to produce the final deliverable. This approach blends technology with traditional digital artistry to deliver high-quality, one-of-a-kind artwork that AI cannot achieve.
Our service focuses on delivering artwork that aligns with client specifications, including D&D character portraits, story and fantasy character illustrations, portraits from photos, MMO game characters, and landscapes, all backed by our Heroic Money-Back Guarantee. The process is designed to honor the creative vision behind your commission, prioritizing the human touch to make your vision unforgettable.
SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
SECTION 7 - OPTIONAL TOOLS

We may also, in the future, offer new Services and/or features through the website (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.
SECTION 8 - THIRD-PARTY LINKS
Certain content, products and Services available via our Service may include materials from third-parties.
Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or Services of third-parties.
We are not liable for any harm or damages related to the purchase or use of goods, Services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.
SECTION 9 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If, at our request, you send certain specific submissions (for example contest entries) or without a request from us, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.
You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.
SECTION 10 - PERSONAL INFORMATION
Your submission of personal information through the store is governed by our Privacy Policy, which can be viewed here: https://framedfantasy.com/policies/privacy-policy

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.
SECTION 13 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. In no case shall FramedFantasy, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 16 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
